I. Introduction
1. These Trading Battles Reward Tournament Terms & Conditions regulate running tournaments with prizes (the “Reward Tournament”) on or via the TradingBattles.com platform (the “Platform”).
2. Unless specified otherwise in announcement, notice or other communication regarding given Reward Tournament, the Platform is the organizer of the Reward Tournament.
3. The Reward Tournament is an interactive trading contest with virtual assets (crypto currencies) conducted on a real time trading simulator using a virtual (mock) pool amounting to USDT 10,000 available for each eligible player.
4. During the Reward Tournament only spot trading (BUY/SELL) transactions may be performed (no long/short positions, no leverage).
5. The Reward Tournament is a game of skills, as it requires from its participants knowledge and skills in trading.
6. All relevant specific details regarding particular Reward Tournament, including but not limited to: the exact name of the given Reward Tournament, its starting and closing dates, trading pair(s), amount of the prize or prizes, number of players to be rewarded with the tournament prize(s), shall be announced on the Platform and the Platform’s social media channels before the given tournament starting date.
7. The Reward Tournament may be run under various names like e.g. Trading Battles Tournament, Trading Battles Elite, Trading Battles Arena, Trading Battles Showdown, Trading Battles Century, Trading Battles Conquest, Trading Battles Challenge, Trading Battles Face-Off, Tournament of the Month, mix of the names or their parts or also other names provided that in the given tournament there is specified at least one reward for the winner.
II. Rules of the Reward Tournament
1. The Reward Tournament is offered and available only to users who are natural persons of legal age, i.e. 18 years or older if required so in the users’ jurisdiction or place of residence.
2. In order to participate in the Reward Tournament the user must register and open their account on the Platform.
3. The user may have only one account on the Platform.
4. To access the Platform and the Reward Tournament the user must have access to the
Internet. It is the user’s responsibility solely to maintain the Internet connection during the Reward Tournament.
5. The user may join the Reward Tournament at any point of its duration.
6. Each eligible player is provided with a virtual (mock) pool amounting to USDT 10,000 which should be used for making on a real time simulator buy and sell transactions of the available virtual (mock) assets during the Reward Tournament.
7. No deposits or entry fees apply.
8. All the virtual (mock) assets purchased by the player during the Reward Tournament and not sold at the end of the Reward Tournament shall be valued by Trading Battles system at the relevant asset’s prize from the last moment before ending the given tournament.
9. The Platform runs a real time ranking and leaderboard during the Reward Tournament and may maintain them also after the Reward Tournament.
10. The Platform reserves the right to make analyses of the players’ transactions and their results, as well as commenting the transactions, applied strategies and changes in the leaderboard during and after the Reward Tournament.
11. Each player must follow the fair play rule. Any cheating, including using bots, is forbidden and may result in disqualifying the dishonest player from the Reward Tournament and the Platform. Assessment as to which behavior is against our fair play rule is in our sole and absolute discretion. The Platform reserves right and discretion to monitor all games played on our Platform.
12. The winner of the Reward Tournament is the eligible player with best % PnL (Profit and Loss) performance, i.e. with the highest value of virtual (mock) assets on the player’s account gained as a result of participation in the Reward Tournament.
13. In case there is more than one player having the highest value of virtual (mock) assets on their account (there is a tie), the Platform shall organize additional tournament between such players to nominate the final winner. The time, duration and other details of such extra tournament shall be determined by the Platform in its sole and absolute discretion.
III. Prize(s) and tax
1. There is a prize pool provided in each Reward Tournament. If the notice regarding given Reward Tournament does not stipulate otherwise, there is only one prize – for the winner of the given Reward Tournament. The amount of the prize results from the announcement regarding the tournament.
2. In case the prize in the given Reward Tournament is given in a crypto currency, the user being a winner of the given Reward Tournament is obliged to provide the Platform with its crypto wallet address to enable the Organizer to make a payment of the prize.
3. The Platform will announce the winner as soon as the Reward Tournament ends.
4. The Platform will contact the player being a winner of the Reward Tournament by email used by the player while registering on the Platform in order to get the necessary contact details of the winner required for payment of the prize, including the winner’s crypto wallet address and if needed, also the winner’s name and surname, ID documents etc. Failure to provide the Platform with the winner’s crypto wallet address or other necessary information or documents within 30 days from announcement of the Reward Tournament results and its winner shall result in lose of the prize for the benefit of the Platform.
5. It is your responsibility to determine what, if any, taxes apply to the payments you receive, and it is your responsibility to collect, report, and remit the correct tax to the appropriate tax authority. You agree that we are not responsible for determining whether any taxes apply to your use of the Services, or for collecting, reporting or remitting any taxes arising from any use of the Services.
6. You acknowledge that we may make certain reports to tax authorities regarding prize you received from the Platform, and that we may, in our sole discretion or as required by applicable law, provide you with additional documentation or records needed by you to calculate any tax obligations. We may also withhold and deduct at source any taxes due under applicable law in our sole discretion.
IV. Miscellaneous
1. The Platform reserves the right at any time in its sole and absolute discretion to determine and/or amend or vary these Terms and Conditions without prior notice, including but not limited to canceling, extending, terminating, or suspending the Reward Tournament, the eligibility terms and criteria, the selection and number of winners, and the timing of any act to be done, and all participants shall be bound by these amendments.
2. The Platform reserves the right to cancel the Reward Tournament at any time in its sole and absolute discretion and for any reasons without prior notice.
3. The Platform shall not be liable for any losses or damages you may incur as a result of your participation in the Reward Tournament and/or use of the services.
4. The Reward Tournament may be held only on territories of countries where it does not violate any applicable national, regional, local or international law or regulation or it is not required to get any special permit, license or meet other special requirements or formalities for its running. Users are responsible for informing themselves about and observing any restrictions and/or requirements imposed with respect to the access to and use of the Platform or participate in the Reward Tournament in each country/region from which the services are accessed. This is the user’s responsibility to apply for participation in the Reward Tournament only if it would not violate your local laws and regulations as specify above. In particular users from the United States of America and South Korea are not allowed to take participation in the Reward Tournament.
5. The Platform reserves the right to change, modify or impose additional restrictions with respect to the access to the Reward Tournament or the Platform from time to time in its sole discretion at any time without notification.
6. The Reward Tournament is regulated by these Reward Tournament Terms and Conditions as well as the Terms of Use and policies as available on the Platform. All matters relating to the Reward Tournament not regulated in the abovementioned regulations and any dispute or claim arising therefrom or related thereto (in each case, including noncontractual disputes or claims), shall be governed by and construed in accordance with the internal laws of Poland without giving effect to any choice or conflict of law provision or rule (whether of Poland or any other jurisdiction).
7. Any legal suit, action or proceeding arising out of, or related to the Reward Tournament or the Platform shall be instituted exclusively in the courts of Poland, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms and Conditions, our Terms of Use or our policies as available on the Platform in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts, unless the prevailing legislation allows otherwise (and then only to the extent allowed under such prevailing legislation).
